CaféWell is not intended for individuals under the age of 18. If you are under the age of 18, please do not attempt to create an account on CaféWell or provide us with any personal information of any kind. A parent or guardian, however, may use The Website to establish a CaféWell account for a minor. The parent or guardian is solely responsible for providing supervision of the minor's use of their CaféWell account. The parent or guardian assumes full responsibility for ensuring that the registration information is kept secure and that the information submitted is accurate. The parent or guardian also assumes full responsibility for the interpretation and use of any information or suggestions provided through CaféWell for the minor.
Before you are able to access and use CaféWell you will be required to create and register an account, which will be protected by a password of your choosing. It is important that you do not share your personal account or account password with anyone. Doing either will compromise our ability to protect your personal information.
CaféWell collects Personally Identifiable Information ("PII," defined below), which you voluntarily submit to us during the account creation process. This information assists CaféWell in managing the site and its content, and helps us personalize your experience on the site as much as possible. Additionally, CaféWell may collect PII you provide if you register for certain programs (challenges, etc.); if you ask us to furnish you with certain products or services; or in connection with content or suggestions you submit to the site.

There are a variety of types of PII that CaféWell collects. Non-Personal Information and Personally Identifiable Information ("PII"), both of which are discussed below.

Non-Personal Information or "NPI" is information that is recorded about users and aggregated into groups or categories, but does not provide any information that could personally identify an individual.
Registration & Account Information
As stated above, CaféWell requires that you provide certain personally identifiable information during the registration process as well as optional information in your user profile. Examples of such information can be, but are not limited to, things like your name, birthday, email address, and optional data such as city, state, zip code, country, and health interests.
As part of the registration process, you will also be required to create an account password, which will be stored with CaféWell.
Some of the information you provide when you register will be visible to other people visiting the site. Members may control some profile fields, which other members can see, by adjusting the privacy settings on their account.
The purpose of CaféWell is to allow members to communicate about various health issues affecting them in the hope that a market place of ideas will help promote the quality of our member’s health and healthcare. To that end, members will have a variety of methods to communicate with each other including but not limited to email, private messaging and posts to the CaféWell site. Each time a content creation feature on the CaféWell site is used, the information contained in that communication will be available not only to the recipient, but to CaféWell as well. Although CaféWell will make reasonable efforts to safeguard this information, it is important for members to understand that CaféWell makes no representations regarding the confidentiality of any given communication notwithstanding that the correspondence may involve the communication to a medical professional.
- Forums and Posts to CaféWell
One of the most important features of CaféWell is the ability for members to communicate with each other and with health care professionals through the use of posts or forums, which allow the user to create content on The Website. When a member creates or posts content on CaféWell, he or she shares it with the CaféWell community at large. Additionally, because CaféWell provides opportunities for members to integrate their CaféWell experience with other social networking websites, it is possible that information posted on CaféWell may be made available to the outside world. Therefore, if a member chooses to post information on CaféWell, he or she automatically makes that information public, not only to the CaféWell community but also potentially to non-members. Because of this, CaféWell strongly encourages its members to think twice before posting any Personal Identifiable Information or any health or medical information, as that information may be seen or used by other members without your knowledge or consent.
- Invites, Emails and Friends
If you choose to communicate directly with other members on CaféWell, those members may be able to view certain PII related to your account such as your email address, your user name and any information that you choose to post on The Website. Likewise, if you send an email to a member or invite a non-member to join CaféWell we will provide your name and your email address to the intended recipient.
- Newsletters & Blogs
Members may sign up to receive regular updates, blogs or newsletters regarding particular topics of interest to them. If you have indicated through your profile settings that you wish to receive updates on discussions, blogs, news, connection requests or other items of interest, you will receive periodic communications from CaféWell. Members may also automatically receive updates from other members they have accepted as Friends on CaféWell.
Members will have the ability to participate in various health "challenges" as more set forth under CafeWell’s Terms and Conditions. Members who participate in these challenges may be disclosing personally identifying information by participating.
- Communications from CaféWell
CaféWell may combine any public information you provide with information from other users to create Aggregate Data to display on the CaféWell site. This information may include, but is not limited to such characteristics, as age, sex, zip code, etc. This information may also be disclosed to third parties. Aggregate data does not contain any information that could be used to contact you, identify you, or associate any health condition with you personally. For example, CaféWell may use information gathered to create a composite profile of all the users of a particular third party site. These third party websites may use this information to understand community needs and to design appropriate programs and activities on their site.
Information Collected by Third Parties Not Acting on Behalf of CaféWell
We will not share your PII with advertisers without your consent. CaféWell may use a third party advertising network provider to help present advertisements on The Website. Third-party advertisement serving enables CaféWell to target advertisements to you based on products and services you may be interested in.
Under no circumstances will CaféWell provide your PII to advertising partners without your consent.
Disclosure of Your Information
In addition to disclosures that you specifically authorize, CaféWell may disclose personal information as follows: We may release Personally Identifiable or Personal Health Information to third parties: (i) in order to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order; (ii) in response to a physical threat to you or others, to protect property or to defend or assert legal rights, or (iii) in connection with a transaction or proceeding involving the transfer of all of part of our business relating to the information, or involving the transfer of control of those assets involved in such business. Any and all attempts by CaféWell to provide notification will be made solely by email and exclusively made to the email address the member has registered with The Website.
Disclosure to CaféWell Staff and Moderators
CaféWell staff and community managers may have brief and limited access to your Personally Identifiable Information in the course of providing products or services to you and other members, to troubleshoot problems or resolve complaints. Access to your Personally Identifiable Information is limited to the information reasonably necessary for the employee to perform the function needed to resolve the issue or to improve the service.
Disclosure to CaféWell Operations and Maintenance Contractors
CaféWell operations and maintenance contractors may have brief and limited access to your Personally Identifiable Information while providing products or services to CaféWell. These contractors include vendors and suppliers that provide us with technology, services, and/or content for the operation and maintenance of our Website. Access to your Personally Identifiable Information, by these contractors, is limited to the information reasonably necessary for the contractor to perform his or her limited function for CaféWell.
Information You Provide on CaféWell
- Your License To Post Information
You represent that the content, you post, share or otherwise distribute on CaféWell, (hereafter "User Generated Content"): (i) will not infringe any other party's copyright, patent, trademark, trade secret or other proprietary rights; (ii) will not violate any law, statute, ordinance or regulation; (iii) will not be obscene or contain child pornography; (iv) will not contain any viruses, worms, time bombs or other computer programming code that is intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; (v) will not violate any third party's rights of publicity or privacy; and (vi) will not be defamatory, unlawfully threatening or harassing, harmful to minors in any way, or otherwise offensive or inappropriate. You are responsible for complying with all laws applicable to your User Generated Content. You also agree to indemnify, and hold harmless, CaféWell for any and all fines or penalties it should incur based on your violation of the above.
- CaféWell's License To Use Information
Updating and Removing Your Information
You have the right to access, correct and delete inaccuracies in your personal information and privacy preferences at any time. With respect to Registration Information, this may be accomplished by logging in to your account on The Website, where you can view and make changes to your personal information. With respect to User Generated Content, you may have a limited ability to edit or delete depending on the specific portion of The website to which it is posted. For example, a member will not have the ability to edit or delete information posted in a forum, although a member will generally have the ability to edit or delete information posted on his or her own personal page.
Notwithstanding whether the member has an ability to edit or delete information seen by others, it is imperative for members to understand that even if a member deletes any User Generated Content from the view of others, such information may still be stored on other databases, specifically, including those kept for archival purposes. CaféWell will not endeavor to retrieve deleted content from our archives in order to erase it from the archives. Also, members should be aware that any User Generated Content that you post may have been republished or distributed prior to deletion and may remain publicly available on another portion of The Website or otherwise.
It is important for you to be mindful that the content you create on CaféWell may be available to the general public and may be collected, copied or indexed by third parties such as search engines (Google, etc.). As such, CaféWell reminds you to think carefully before you post any information on the site.
